AIA BIM Protocol (E202)

Despite my recent ranting (aka constructive crticism) about the AIA's communication practices, I would like to discuss one of their newest contract documents - AIA E202-2008: Building Information Modeling Protocol Exhibit. As recently discussed by Jim Bedrick (Webcor Builders) in a featured article on AECBytes.com titled "Organizing the Development of a Building Information Model," the BIM Protocol has evolved from work initiated by Vico Software and Mr. Bedrick which was subsequently presented to the AIA's Integrated Project Delivery (IPD) Task Force. This document takes an important step towards the effective downstream use of BIM data by a project team. A free sample can be obtained from the AIA at www.aiacontractdocuments.org.

In a previous post, I had discussed the use of disclaimers for added protection from liability when sharing native design data with team members outside of the Design Team. To make the next logical step - from "little BIM" to "BIG BIM" - I have been conducting discussions with my colleagues, peers and our firm's legal counsel about ways to start "chipping away" at the shield (disclaimer) in an effort to establish usable and controllable channels of BIM data. To that end, the AIA has released E202 to address the issue of integrating BIM data into the contractual environment. It begins with the general "protocol" in which project teams can define procedural details such as Model Management, Model Ownership and Coordination & Conflicts. While these areas are important to define, the key part of E202 is the definition of two fundamental concepts: Level of Development (LOD) and the Model Element Author (MEA). These two categories are then combined in a matrix for each phase of the project, corresponding to model element assemblies in the Model Element Table described in greater detail below.

BIM arguments

To the best of my memory, these are the arguments I’ve received so far for Business In Motion International. I have not attended a meeting, so it is possible that there may be more information/arguments. However, I have researched this a great deal, including contacting the Better Business Bureau, RCMP, and the Competition Bureau of Canada, and many of these arguments will not benefit from additional claims or data. I would be justified at this point to refuse to attend a presentation, never mind committing to an investment of thousands of dollars and to recruiting others (usually friends and family).

1. Q: What makes businesses like Microsoft, McDonald’s, and Walmart successful? A: A revolutionary distribution system.

a. This claim is suspect, since it confuses cause with effect. If these companies indeed possess markedly better systems to distribute their product, it is only on account of the product’s (or service’s) success. Microsoft originally stems from Gates’ programming expertise (among others) and continues with product popularity. McDonalds may not produce quality food, but it is distinctive in taste and cheap. Walmart is indeed a leader in logistics, but this would still be useless without either decent products or a better choice of products than most.

2. (Stemming from 1) BIM has a revolutionary distribution system, therefore it too will be successful. (This also seems to be used to establish BIM as a legitimate business.)

a. “Distribution” is not used consistently; a bait-and-switch. (1.) intends to establish the importance of a distribution system, and in (2.), BIM’s distribution system is implied, but is left undefined. Without more info, I can only guess that BIM’s method of recruiting new people to buy/sell product and recruit more is then labelled as distribution, which is very different from the examples given.

b. (1.a) is not addressed: what is a good (even revolutionary, as is claimed) system for distribution if the product is not successful, or even marketable?

i. My review of a product proved underwhelming: many hotels around the world could be booked for low prices, but primarily in off-season times. Furthermore, airfare was not included, meaning typical and easily available package deals (hotel + airfare) are cheaper. The counterargument made was that this product was merely one of many. When I asked for an example, none was forthcoming.

ii. One tendency of typical pyramid schemes is product loading, where new recruits are pressured to buy the product, often in large amounts. Return policies may be non-existent or disadvantageous. I do not know if BIM includes these policies, but it would be interesting to find out, since this reveals the product as being unmarketable; a business with a product few or no people will buy is untenable.

BIM and Lean Construction Reduce Risks, Collaborative Agreements

The specter of liability rears its head whenever IPD and BIM are discussed, but too often those discussions ignore the risk reduction mechanisms in quality Collaborative Agreements and the risks mitigated by the effective use of BIM and Lean Construction techniques.

There are three powerful mechanisms in a quality Collaborative Agreement that substantially reduce the risk of litigation and empower the parties to resolve disputes - which are inevitable - in a collaborative and efficient manner. The first mechanism actually consists of two waiver provisions in such agreements, one via which the parties waive claims for decisions made by consensus and a second whereby the parties waive claims for consequential damages. While not particularly novel, these two provisions effectively eliminate an entire swath of potential claims among the parties to the agreement. When subcontractors and consultants sign joining agreements, binding themselves to those same provisions, even more claims are eliminated.

The second mechanism it the malleable laddered alternative dispute resolution clause (Laddered ADR Clause) found in most Collaborative Agreements. Laddered ADR Clauses contractually mandate parties to disputes actively engage in open and honest communications to resolve disputes and do so at the field level, manager level, supervisor level and executive level, in succession. If those efforts fail, then the third risk mitigation feature of a Collaborative Agreement comes into play.

The third prominent risk mitigation feature built into a Collaborative Agreement is the pre-contract selection and mandatory use of a Project Neutral, or on bigger projects, a Dispute Review Board. Disputes that cannot be resolved through the process detailed in the Laddered ADR Clause must be mediated, and ultimately arbitrated before a Project Neutral or a Dispute Review Board. By waiving the right to litigate disputes, and agreeing instead to submit irreconcilable disputes to mediation/arbitration, the parties can ensure resolution of almost all project related claims within the four corners of the Collaborative Agreement.

In addition to the risk mitigation features built into a quality Collaborative Agreement, BIM and Lean Construction methods themselves empower stakeholders in an IPD environment to actively mitigate risks. A quality BIM strategy, implemented from the outset under the experienced eye of a professional BIM consultant will eliminate countless delays and mistakes. Likewise, a quality Lean Construction program – one that taps the timely and accurate design data generated through the quality BIM Strategy and utilizes a quality Lean Supply Chain manager - will empower the parties to surface and resolve design and constructability issues of all kinds in advance. These tools will wring an amazing amount of inefficiency out of the design and construction processes and the supply chain. These tools and processes reduce risks by obligating the party in the best position to mitigate a particular risk at a particular moment in time with the duty of doing so.

In an IPD environment, project risks - like project costs - can be reduced substantially through effective use of BIM and Lean Construction techniques, and the Collaborative Agreements that support them. Further, the more collaborative tools you deploy in an IPD environment, the more risks you mitigate and the more costs you save. Keep that fact in mind when the specter of increased liability is raised as barrier to IPD and BIM.

While the specter of increased liability pales significantly in the perfect IPD environment, it is rare indeed that a project is completed in such an environment. The more common scenario involves a piecemeal implementation of the collaborative tools described above under a series of traditional construction contracts that pit the economic interests of stakeholders one against another, spawning disputes, distrust and – too often – litigation. In such an environment, the specter of litigation and ensuing liability is very real, and worthy of analysis.

BIM, or building information modelling, has long been hailed as the next generation of computer-aided design, offering the capability to create an easily altered 3D model of a building, and the opportunity to make that model intelligent.

Traditionally, computer modelling in architecture has been viewed as a purely graphical tool that can help deliver consistent drawing information. The BIM model encourages a shift away from that mentality, encompassing real-life simulation and analysis of a building’s performance.

Ultimately, the software developers behind the technology aim to deliver programs that enable architects to create a prototype of their building while measuring its performance from the earliest conceptual stages.

Tests can be run after every design decision or change to see what the effect would be on the project, while information from the model could be used by engineers, component manufacturers, service providers and clients to make projects more efficient.

By including information from manufacturers of individual components, the software can enable architects to make better decisions about what materials to use. It can also test the environmental performance of a building, checking it against Breeam and Leed standards.

Centralising all this information into a data file is intended to help foster a more collaborative process so that engineering and building services information becomes part of the design process, enabling each team that works on a building to input its own information while the architect adapts the design.

In Singapore, BIM models are now mandatory as part of the planning process, and are uploaded into a central model. In January, they will also become mandatory in Denmark.

Pete Baxter, Autodesk sales director and architecture specialist, says BIM could now begin to make its mark in the UK, with better technology offering a new approach to cost management and project efficiency. Baxter, who qualified as an architect just as the recession of the early nineties hit, is one of BIM’s proselytising evangelists.

The software he promotes, Revit, undergoes yearly updates and provides programs for architecture, planning and services.

"Revit has grown by about 50% year on year in terms of installations. It allows the project team to collaborate through a single model environment, and that has made a big difference to the way people perceive BIM," says Baxter.

RSMeans Business Solutions, a division of Reed Construction Data (www.reedconstructiondata.com), recently conducted a comprehensive study to determine how quickly the industry is embracing building information modeling (BIM) and discovered that the rate of adoption has increased significantly over the last 12 months.

In this study, an RSMeans project team conducted surveys and interviews among several architectural firms across the United States, focusing on BIM adoption rates, how adoption varies between large and small architectural firms and the effects on productivity.

The anticipated rapid adoption of BIM indicates the true power of the technology in changing processes as well as the need for education, training and intuitive tools that will facilitate the BIM experience Out of the offices sampled that use BIM, 96 percent indicated they adopted it within the last 12 months and nearly half of all respondents estimate that all projects will use BIM within one to two years.
